Terms of Use for the play-avatar Platform

Lanes AI LLC (together with its affiliates and subsidiaries, "we", "us", "our", or "Lanes AI") provides the play-avatar Platform, accessible at https://play-avatar.app (the "Platform"), subject to these Terms and Conditions ("Terms"). These Terms apply to all users of the Platform, including both registered and unregistered users ("Users"). References to the "Platform" include the website, applications, and related services unless explicitly stated otherwise.

By accessing, using, or browsing the Platform, you agree to be legally bound by these Terms and all policies and guidelines incorporated by reference. If you do not agree with these Terms in their entirety, you may not use the Platform and should exit immediately.

For enterprise customers with a separate signed agreement with Lanes AI, that agreement will govern in case of any conflict with these Terms.
1. Definitions
  • Platform: The play-avatar Platform is a proprietary software platform developed and maintained by Lanes AI, including software applications, user interfaces, backend systems, databases, APIs, documentation, updates, upgrades, enhancements, and related support services. It enables Users to create, edit, manage, export, and engage in interactive role-play training scenarios.
  • Subscription Plan: A predefined package detailing the scope of your rights, limitations, and access to the Platform, including the maximum number of Authors, Projects, and Sessions.
  • Author: An individual authorized to create, edit, and export role plays within the Platform.
  • Project: A distinct workspace within the Platform for creating, editing, managing, exporting, and storing role plays.
  • Session: A single, discrete role-play interaction on the Platform, counted when the first phrase is recorded, with a maximum duration of five (5) minutes.
  • User Content: Any content, data, or materials uploaded, created, or submitted by Users on the Platform.
2. Acceptance of Terms
By using the Platform, you confirm that you have read, understood, and agree to be bound by these Terms. Lanes AI reserves the right to modify these Terms at any time. If changes are made, we will notify you via the email address provided in your registration information or through a notice on the Platform. If you do not agree with the changes, you may cancel your account or stop using the Platform. Continued use after changes constitutes acceptance of the modified Terms.
3. User Accounts
To access certain features of the Platform, you must register for an account. You agree to:
  • Provide accurate, current, and complete information during registration ("Registration Data").
  • Maintain the security of your password and account credentials.
  • Promptly update Registration Data to keep it accurate and complete.
  • Accept all risks of unauthorized access to your account or Registration Data.
  • Be responsible for all activity on your account, including any fees incurred for paid features or services.
4. Subscription Plans and Fees
Some features of the Platform may require a paid subscription. Subscription terms, including pricing, billing cycles, and payment methods, will be clearly presented to you before you agree to such features. By subscribing, you agree to pay all applicable fees associated with the subscription. If you do not agree to the terms presented, you may choose not to proceed with the subscription.

All payment processing for the Platform is handled by Stripe. For more details on payment processing, please visit Stripe’s website.

Cancellation
You may cancel your paid subscription at any time through the account management settings in the Platform. Payments are non-refundable, except where required by law. These Terms do not override any mandatory local laws regarding your cancellation rights. For more details about how to cancel your subscription, please refer to the instructions provided within the Platform or contact us at support@play-avatar.app.
5. Ownership and Intellectual Property
  • Platform Ownership: Lanes AI retains all rights, title, and interest in the Platform, including all intellectual property rights. No ownership rights are granted to Users.
  • User Content: You retain ownership of your User Content. By uploading or creating User Content, you grant Lanes AI a limited, non-exclusive, worldwide, royalty-free license to use, store, and process User Content solely to provide, maintain, and improve the Platform.
  • Third-Party Software: The Platform may include third-party software components, subject to applicable third-party licenses provided in the Platform documentation.
